Public Release of Confidential Resolutions
Reports to closed meetings are deemed confidential in accordance with Section 10A of the Local Government Act 1993, which permits the meeting to be closed to the public.
Council has an obligation to release confidential resolutions passed at closed meetings to the public In accordance with Local Government (General) Regulation 2005. Part 10, Division 3, Clause 253 of the Regulation, which is reflected in Council’s Code of Meeting Practice states that:
"If a council passes a resolution during a meeting, or a part of a meeting, that is closed to the public, the chairperson must make the resolution public as soon as practicable after the meeting or part of the meeting has ended."
In some instances an action may need to be completed or event concluded before a confidential resolution can be publicly released. Council commits to releasing confidential resolutions as soon as practically possible.
