Outdoor dining

Approved restaurants and cafes can apply to Council to place outdoor dining furniture on the footpath directly in front of their premises for the use of their customers. 

You must lodge an application with Council, providing documentation including a scaled plan showing the property boundary, the area of footpath to be utilised  and any existing street furniture, as well as details of your current public liability insurance.

Council may need to seek further approval from Transport for NSW for all premises located next to a classified road, such as those along sections of Penshurst Street and Mowbray Road. These approvals may have additional requirements. 

Food businesses with a seating capacity of more than 19 patrons must provide toilets for them within the building.

Outdoor dining fees and charges apply and are payable annually in advance or by direct debit on a monthly basis.
