Heritage Items

If a property is listed as a Heritage Item, it is identified in Willoughby Local Environment Plan 1995 (WLEP 1995) or in the Sydney Regional Environmental Plan No.5 (SREP No.5) as being an important part of the area’s heritage. Recent studies show that heritage listed properties are sought after by buyers, and a heritage listing can contribute positively to property values.

There are special benefits given to listed properties.

Council waives Development Application fees for Heritage Item owners, and a reduction in land tax is available. For more information on the reduction contact the Office of State Revenue on 1300 139 816.

Heritage Items can be used for any purpose (for example, commercial, residential) as long as the proposed use doesn’t negatively effect the building’s heritage or the amenity of the neighbourhood.

There are concessions for determining floor space ratios and parking requirements.

There are additional controls for sites surrounding a Heritage Item to protect the building and its setting.

Development Consent from Council is needed before a Heritage Item is altered, demolished, or has additions made to it. The application for this kind of work must show that the impact the changes will have on the heritage value of the site have been considered and that there will be no adverse effect.

If there is no adverse effect, consent can be granted.  If there are adverse changes, Council can help owners adjust the proposal to both protect the property and satisfy the owner’s changing needs.

Like all development applications, a refusal by Council can be challenged in the NSW Land and Environment Court.

Dual occupancy development is not permitted in regards to Heritage Items or sites adjoining Items, unless the changes involve minimal or no change to the external appearance of the building.

  • The NSW Heritage Office displays and sells a wide range of publications, serials, monographs, conservation plans, consultants’ reports, completed projects and brochures.
  • Council can provide a list of experienced Heritage Consultants and Architects.
