Exempt Development

What is Exempt Development?

Some minor building renovations or works don’t need any planning or building approval, and qualify as Exempt Development. Exempt Development is very low impact development that can be done for certain residential, commercial and industrial properties.

To qualify as Exempt Development, you must satisfy all of the development standards identified in State Environmental Planning Policy (Exempt and Complying Development Codes) 2008. The policy can be viewed at the NSW Legislation website. If any of the criteria cannot be fully met, a Complying Development Certificate or Development Application approval must be obtained before carrying out the work or development.

Examples of Exempt Development include some types of:

  • decks
  • carports
  • fences
  • aerials
  • air-conditioning units.
