Background Reports
The following reports provide the research and background information for the development of Draft Willoughby Local Environmental Plan 2009 for all areas of the City other than Chatswood CBD. These reports formed the attachments to the Council report of 5 March 2008 and the basis for the provisions within the draft Plan.
It should be noted that the Section 65 Certificates issued by NSW Department of Planning may override any statement contained within the reports.
Draft Willoughby Structure Plan
The Willoughby Structure Plan discusses the framework for strategic land uses planning in the City to the year 2020.
Residential
This report explains how the existing residential zones from Willoughby Local Environmental Plan 1995 were transferred to Draft Willoughby Local Environmental Plan 2009. It also details the residential areas proposed to be rezoned as well as the policy context and assessment of housing data and needs.
Please note that this report has been partially superseded by the Section 65 Certificate issued 8 July 2009 which instructed Council to zone some Special uses sites to the surrounding zone.
This was revised by the 2nd Section 65 Certificate dated 15 February 2010.

Page 18 and page 95 - Reference to reclassification info for 17 Glenmore is incorrect. The land at 17 Glenmore is already operational land. Therefore, Draft Willoughby Local Environmental Plan 2009 does not propose to reclassify the land.
Page 58 - Site No 7 – land at 1-13 Brand Street, 2-14 Hawkins Street, 1-11 Hawkins Street, 2-12 Drake Street, 1-13 Drake Street, 8-14 Raleigh Street, 1-7 Raleigh Street, 340 Mowbray Road and 44A- 52 Elizabeth Street, Artarmon – height and fsr proposed within this report was superseded by the Council resolution of 5 March 2008.

Preliminary Rezoning Assessment
The following schedule identifies sites and precincts that were considered by Council Officers for rezoning to permit higher density residential use. Some of the sites were subject to more detailed assessment in the preparation of the draft LEP proposed rezonings.
The accompanying map shows the overlay of constraints that were also considered in the Preliminary Rezoning Assessment.
These documents did not form part of the original reports to Council. They have been provided at the request of local residents during the exhibition period.
Business Centres
This report discusses the local commercial centres of Willoughby including the proposed controls for business zones in the Draft WLEP 2009.

Page 44 - regarding properties at 156-174 and 216 – 234 Victoria Avenue Chatswood. The FSR proposed within this report was superseded by the Council resolution of 5 March 2008 which changes the FSR to 2:1.
The report mentions that a clause limiting showrooms to less than 100 sqm would be included in Draft WLEP 2009. This clause is not included in the final Draft WLEP 2009.
Industrial Areas
This report provides the policy context and the new proposed zones for the industrial areas at Artarmon, St Leonards and East Chatswood.

Page 7- The Starch Mill at 170 Epping Road, Lane Cove North, has not been listed in schedule 1 as discussed in the Council Report and will retain its current existing use rights.

Open Space
This report provides the policy context and the proposed new Recreation and Environmental Protection zones for open space areas.

Page 28 - reference to reclassification of Lot C DP 160424 is incorrect as this Lot is part of unmade road.
Page 9 - Lots 39-42 DP 6689 Edinburgh Road Castlecrag. The State Government has recently agreed that Lots 39 and 40 Edinburgh Road be zoned E2 Environmental Conservation and Lots 41 and 42 Edinburgh Road be zoned E4 Environmental Living. This is confirmed by Section 65 Certificate dated 15 February 2010.

Special Uses, Infrastructure and Unzoned Land
This report details the existing special uses and unzoned land within Willoughby Local Environmental Plan 1995 and how they have been transferred to Draft Willoughby Local Environmental Plan 2009.
Please note that this report has been partially superseded by the Section 65 Certificate issued 8 July 2009 which instructed Council to zone some Special uses sites to the surrounding zone. The 2nd Section 65 Certificate dated 15 February 2010 amended this by advising that sites owned by Energy Australia, Chatswood High School and the Acoustic Laboratory at 126 Greville Street, West Chatswood should be zoned SP2.
